Debunking the Asbestos Cut-off Myth: A Discussion with Kevin Hutton and Russell Vent

By Kayla McGowan
January 3, 2025

In this episode of Ask the Expert, we delve into the complex world of asbestos regulation and safety with two industry experts, Kevin Hutton and Russell Vent. They've written a two-part piece that covers the EPA, OSHA and much more, shedding light on the often misunderstood asbestos cut-off myth.

Kevin Hutton is the President and CEO of EAST Centers of NY, a leading provider of asbestos, environmental, and safety training. He co-chairs the Environmental Information Association's Asbestos Committee and serves as EAST's training director for various safety programs. Kevin is also an expert witness in asbestos work practice cases and a certified OSHA outreach trainer. In his free time, he enjoys landscape photography.

Russell Vent is the Vice President of Paul Davis Restoration of Greater Rochester, NY, where he leads full-service restoration for commercial and residential clients. He holds multiple IICRC certifications, including Master Fire Restorer, and is a Council-certified Microbial Remediation Supervisor. Russell also serves as Vice President of the Professional Abatement Contractors of New York and is involved with the American Red Cross Greater Rochester Chapter.

Key Discussion Points:

1. Contention and Misunderstanding Around Asbestos Testing: Kevin and Russell discuss why there is so much contention and misunderstanding around the requirement for asbestos testing in the construction and restoration industries. They highlight common misconceptions and excuses used to avoid testing, and how these impact safety.

2. Federal Regulations and Contractor Responsibilities: They explain how federal regulations, such as the EPA's National Emission Standard for Hazardous Pollutants (NESHAP), address the need for asbestos testing and the responsibilities contractors have under these regulations.

3. OSHA's 1980 "Presumption Rule": Kevin and Russell discuss how OSHA's interpretation of the 1980 "Presumption Rule" contributes to confusion regarding asbestos testing in the industry.

4. Responsibilities of Building Owners and Employers: They highlight the responsibilities of building owners and employers according to OSHA for investigating and identifying asbestos-containing materials in structures built after 1980.
