7 Habits of Highly Ethical Insurance Claim Handling Practices
Understanding the roles and boundaries in handling property damage insurance claims is critical to everyone in the industry. As insurance companies seek to strip out consumer protection and water down policy coverage, they blame non-licensed public adjusters, door-to-door soliciters, deductible schemes, lawyers using runners, contractors acting as public adjusters, restoration companies inflating estimates, lawyers disguising payments for cases as "estimating fees", roofers acting as bogus public adjusters and "claim consultants" promising teams to handle claims to support their agenda. In this valuable lunch session, learn how your business can stand above the pack and what you can do to help protect policyholders.
12:00 pm - 1:00 pm - Lunch with Joe Radcliff, CEO & Founder - National Insurance Restoration Council
Mr. Radcliff is widely known for winning the largest defamation case in American history ($14.5M) against State Farm. Listen to Joe share his David vs. Goliath multi-year battle which Radcliff utlimately won. He brings 23 years of solid experience to the construction industry, including 18 years operating his own construction and insurance restoration company throughout 16 states across the U.S. Joe recently founded the National Insurance Restoration Council (NIRC) to pave the way in much needed industry reform. The NIRC is a non-profit organization devoted to protecting and educating property owners and restoration contractors when dealing with insurance claims.
1:00 pm - 1:45 pm - Legal Panel - Unfair Claims Handling Practices
Moderator: TBD Discover the standards for the investigation and disposition of claims under insurance policies. Find out the in's and out's of what guidelines and timeframes insurers must follow and not misrepresent to claimants as well as provide insureds relevant facts or policy provisions relating to coverages at issue. Attendees will learn how to identfiy acts of bad faith.
1:45 pm - 2:00 pm - Networking Break - Meet the Vendors
2:00 pm - 2:30 pm - Public Adjuster Panel - What's up with UPPA?
Moderator: Rob Kitto Public Adjuster/K2 Consulting - Rob has nearly 20 years of experience in claims adjusting as both an independent and public adjuster. This panel discusses the Unlicensed Practice of Public Adjusting (“UPPA”) which includes negotiating, interpreting policy language, or acting on the behalf of an insured and is considered consumer fraud. Unfortunately, many contractors are simply unaware of what UPPA is. Find out when or if you should consider referring your client to a public adjuster and gain a deeper understanding of the roles and boundaries when handling claims as a team. We will also discuss if insurers have a duty to report UPPA, what it could mean to you and your business as well as how to avoid UPPA. Public adjusters are heavily regulated licensed insurance professionals that represent consumers in negotiations of first-party property damage claims with insurance carriers. Both insurers and departments of insurance have UPPA high on their radars. This valuable discussion will give you practical approach to avoiding pitfalls of UPPA and streamling the claims handling process.
2:30 pm- 3:15 pm - Appraisal - Tool or Weapon? - Shannon Loyd/The Loyd Law Firm
Find out how recent court decisions are gutting consumer protections for insurance policyholders by abusing appraisal. Texas Supreme Court is now considering hearing an appeal on one of her cases that could give the state's highest court an opportunity to resurrect longstanding consumer protections for property-owning consumers and businesses. Shannon will inform you of what to expect, how much appraisals really cost, why carrier's invoke it and what is a "disinterested party".
3:15 pm - 4:00 pm - Contractor Panel - How to Scale Your Business With Contractors
